it is nothing but an employer letter in which you need to specify your designation and your continuation of your employment with that company. I sent the same letter for H4 stamping to my spouse.

Immigration Visa Attorney Blog Has Just Posted the Following:
http://www.immigrationvisaattorneyblog.com/PPT%20Control.pngWith all our experience counseling on immigration law questions, the attorneys at Fong & Chun in Los Angeles do not regularly get the chance to see the day-in, day-out operations at airports and other ports of entry.
Whether it is Department of Homeland Security (DHS) policy or not, I do not know, but last week, I noticed DHS personnel roaming through the terminals at Dulles International Airport in Washington, DC. They actually went to various gates and randomly requested ID or passports from OUTBOUND passengers seated in the boarding areas.
That is, they checked the documents of both Americans and foreigners who were LEAVING the USA. Not entering.
I followed them around a little bit. The officers were friendly, civil. They approached passengers in the terminal, asked them their final destinations, and asked if they could see their passports. Interestingly, although I was standing right next to a bank of chairs in the boarding area, they did not ask me for my passport, nor did they ask anyone who was standing or walking through the terminal. They only approached persons seated in the departure gate area. I did not see them detain anyone.
I have often been asked whether DHS personnel made random checks of persons in airports. I used to say that "they could, but I've never seen it." Well, I have now. --jcf

hi,
Any attorneys or experts please advice.
I want to have my I - 140 premium processed, I was looking at the following link.
http://www.uscis.gov/files/article/premiumproc_factsheet_i140_061108.pdf
It has mentioned that
Copies of all Forms I-94, Arrival/Departure Record and I-797 H-1B or L approval notices that have been issued on his or her behalf;
Is it true? I have visited india almost 7 times from last 8 years including my F-1 status. With little knowledge I have during that time, I never made a copy or kept a copy of my all I - 94s.
So the question is how big of an impact it will be if I do not have all my I - 94s. And also where can I get copies of my I - 94s if I want.
Thanks for your response.

AILA Leadership Has Just Posted the Following:
Right now, the DHS is in the middle of its Quadrennial review, where, apparently all areas that DHS works on are subject to public comment and discussion. If you go to this page (http://www.homelandsecuritydialogue.org/dialogue2/ideas) you can comment directly on a variety of DHS, including immigration issues. We understand that these comments are given directly to those in the highest levels of office at DHS.
Very few folks have been aware of this opportunity. Probably most important is the way this administration has phrased the debate: "Smart and Tough Enforcement of Immigration Laws - Ideas." (http://www.homelandsecuritydialogue.org/dialogue2/immigration) I invite all AILA members to be part of this public debate. Click on the above links, make your comment and demand real immigration reform, not twisted and ill-directed "enforcement" whose only purpose is to convince congressman who will still never vote for positive immigration reform to actually do so.https://blogger.googleusercontent.com/tracker/186823568153827945-8252864317741860630?l=ailaleadership.blogspot.com

For my case, it looks not very easy to keep the same job title after switching employer. So I'm wondering whether anyone has the experience about how to persuade current employer not to revoke my I-140?
My situation is that the managers of quite a few departments in my current employer like me, but these managers are not getting well with each other. So I actually cannot enjoy this and am suffering the politics. And my pay is quite low, much lower than what I got in previous IT company although at that time I was a very fresh graduate, and also lower than the prevailing pay in this industry in the same city. The only reason I joined this one was for family reason.

thx pappu n aruben for ur responses.
pappu, ur link talks abt GC in EB-5 category. is the requirement of $1 mn investment a reqd condition for this? in other words, if an enterprise can generate jobs for 10+ US citizens by investing a lesser amt, is that valid for filing GC under EB-5 category?

Hello:
I need some help. Here is my situation.
I am in USA on H1B since 1999. I am working with Company A since September 2006 on H-1B. My 485 is filed by Company A under EB3 in July 2007 with PD 10/2006.
I am in process of changing job from Company A to Company B in same field using AC-21 and EAD. My last day with Company A would be June 10th. I have an offer letter from Company B and going to join them on EAD in June end / early July (my start date is flexible). AC-21 will be filed by Company B's lawyers once I join them.
Meanwhile if I want to travel to India (no emergencies, just want to see the family), can I use my AP to return? My current AP expires in December 2011.
Has anyone done this before?
Any help would be greatly appreciated.
Thank you for all your answers.

Here is how you are being perceived in this country (full article link below):
"The process of converting an H-1B immigrant to a permanent visa resident is a long, expensive, tortured process. know of cases that took longer than seven years. My companies liked this arrangement, because it made the workers into long-term indentured servants, who lacked the freedom to quit and work anywhere else, neither could they complain about anything unless they wanted the companies to pull their sponsorship of them"
NumbersUSA Member has first-hand experience with H-1B visa fraud | NumbersUSA - For Lower Immigration Levels (http://www.numbersusa.com/content/nusablog/cchmielenski/march-29-2011/numbersusa-member-has-first-hand-experience-h-1b-visa-fraud.html)
There are a lot of high-powered organizations lobbying/advocating in Washington to ensure that there are more temporary workers - because it is in their benefit. No one emphasizes on green card backlogs!
Immigration Voice is the only organization fighting exclusively for reducing green card backlogs and providing you the much needed flexibility to change jobs, get your green card, allow your spouse work, etc.!

U.S. citizens and lawful permanent residents (LPR) of the U.S. who are pre-approved, low-risk travelers are eligible to participate in the Global Entry Program, which allows expedited clearance upon arrival from international travel. The U.S. Customs and Border Protection (CBP) began their pilot system on June 6, 2009, in seven airport locations throughout the United States. Beginning August 24, 2009, the Global Entry Program will expand the program to include kiosks at 13 additional international U.S. airports including airports in Boston, Massachusetts; Dallas, Texas; Detroit, Michigan; Fort Lauderdale, Florida; Honolulu, Hawaii; Las Vegas, Nevada; N.J.; Orlando, Florida; Sanford, Florida; Philadelphia, Pennsylvania; San Juan, Puerto Rico; San Francisco, California, and Seattle, Washington.
Upon arrival from international travel, approved members of the Global Entry Program will use kiosks and complete their CBP processing. After answering customs declaration questions on the kiosk’s touch-screen, a transaction receipt will be printed. The receipt will be presented to CBP officers before leaving the inspection area. This program is an alternative to regular passport processing lines. Thus, individuals wishing to utilize the program may complete their interview and biometric data collection at enrollment centers at any of the Global Entry sites.
More information on the Global Entry Program (http://www.cbp.gov/xp/cgov/travel/trusted_traveler/global_entry/) is available at the CBP Web site.

Hi,
I looked at different forums. But I could not locate a definite answer for my questions.
I have H1. My wife has H4. Both will expire in 11/2009. I don't have stamp
but she has stamp. We both used AP to enter into USA recently. We did not use our EAD.
Questions on EAD paper filing :
14) Manner of Last Entry into the U.S. ?
15) Current Immigration status ?
I believe that the answer to the question 14 should be PAROLEE or Advance Porole. How about question 15 ?
The immigration officer put 'Conditions: AOS DA' in our AP and new I-94 both. What will be the answer, AOS Pending or H1B/H4 ?
Please share your experience. Thanks in advance.

Hi,
My current situation is as below
I -797 and I-94 expiry date: 10 Jun 2011
Passport expiry : 28 Oct 2011
I am filing for H1 extension through my company immigration cell. However, they informed me that my passport had to be renewed before filing the extension !! else the attached I-94 in the extended I 797 will have the expiry date only till my passport expiry
In that case, if they had to wait for my renewed passport to arrive (which can take longer) to file the extension and my I-94 might expire before that.
Can someone please provide some advice if that's the case?

There is a 245(K) provision that will save your wife - research that and ask your attorney to file 485 for her with that.

I think I found it. For the property you are wishing to limit the range of values to, set the NumberRangesAttribute defined in Microsoft.Windows.Design.Interaction DLL.
