I really like your 3rd and 4th stamps faster :) It's no bother at all. I add stamps every Wed/Fri, so it only takes me about 30 mins to get all of the stamps added up from everyone!

Assuming you meet the requirements for E visa status as an employee and not an owner of the company, this is a viable strategy.

I believe when DOS calculated the Eb2 China demand data for July, they might have taken all apps pending from Nov22 2005 till Dec 31 2005. Considering the apps prior to Nov 22 2005 as demand for June 2010.
Same for Eb2 India from Feb1 2005 till Dec 31 2005. To make note is India dates did not change in June so the demand remains the same for that year.

All this inventory etc dosent make sense ,
Pending EB2 cases for china are around 2000 as per USCIS inventory .
but as per DOS Demand data its only 500 ..
God Knows whats Happening .

Hi,
My L1 and I-94 is valid till August 14th 2009 -- I want to know if I can travel India and come back before it is expired. Are there any restrictions on port of entry when visa is nearing to expire. I would not take chance if there is a porblem in international travel and if I have deportation issues at the point of entry then I am not willing to go. But I want to visit my parents as they are not doing well.
Also, I am thinking once I am back from India then I can apply for L1 visa extension -- is it a good idea to apply for extension after I come back or I can apply and go to India for vacation.
Please guide me as I am in a fix and I am not able to take any decession.

At any International Airport go to US Customs and Border Protection Office. Show then the I-94 with incorrect name along with your passport that has the correct name and they will be able to fix the issue.

Should the job title for PERM labor filing be in Job Zone 5 to qualify under EB2 category? Or could one apply in Job Zone 4 and still qualify for a EB2? Also, does having an MBA, exempt a person from EB quota under any of the proposed bills like STEM, SKIL, PACE, TALENT or should it have to be an MS in Engineering.

I am trying to get a green card for the US. My parents are from east asia and I was born in Canada. I went to University in Maryland from 1992-96 and obtained my dental license. I am licensed in the US and intend to purchase a dental office soon. I will still be keeping my dental office in Canada for at least 1 year once I am able to work in the US. I heard about a investment visa however I am not investing more than $400k but it will employ at least 4 US nationals(ctizens). Can I still use the investment visa or can I get a visa for opening a secondary dental office in the US and still keep my existing office in Canada until I qualify for a green card. Also can anyone recommend a good lawyer. How much should it cost for me and my family(wife and 3 children ). Email me if you wish AT

1.Did anybody have recently got H1B stamping done in Hyderabad consultate.
2. Any issues with getting appointment dates.
3. I have all the documentation in place including pay stubs in the last 8 years.
4. Is it preferable to get stamping done in Canada than in Hyderabad,
5. How many days does it take to get the passport back.
Please share me your experiences,

I have applied for my H1 extension in July 2010 and still waiting for the approval. My in-laws are visiting the US in dec and i am sponsoring their visit. Should my H1B be approved before they appear for the Visa interview or should the H1 receipt notice be enough? Please let me know.

There is no such rule that you should have an approved H1B in hand. However you never know the kind of immigration officer your in-laws/parents see at the embassy. If it is not too urgent wait till your H1B is approved. If it is urgent just write a letter stating the facts accompanied by a copy of your old H1b, new H1B receipt notice and a letter of continued employment from your employer. Yes include other documents like paystubs, past tax returns and etc.

I just called USCIS to check the status of my case and the Immigration Officer said it is in EB-1 category. I know my case is EB-2.
I asked the IO to see if i have send any paperwork to rectify their mistake, but she said USCIS will automatically adjust the category whe it picks up the case for review
I am confused. Please Advice

USCIS is scheduled to accept I-907 Premium Processing Request for Outstanding Researcher I-140 Petitions and Advanced Degree or Exceptionary Ability I-140 Petitions beginning from Monday, September 25, 2006. The categories of I-140 petitions which are excepted from the premium processing services are: EB-1A (Extraordinal Worker), EB-1C (Multinational Corporate Executive/Manager), EB-2(NIW).

I planning to change my employer after 180days and I want go for the fulltime by using my EAD because my I-485 will take next 3 or 4 years (PD May-2007). My present H1 is still Oct 2008 (labor and I-140 cleared).
1. What are the chances for rejecting my I-485 file?

2. If my I-485 file rejected after my H1 expired (EAD using) ?
Ans:You are out of status, switch to in-status, like B1.
