hi,
i entered the US on AP in Jan 2010, and at the time of entry, my I94 validity was set for
1 year (viz Jan 2011) - and the AP also noted "AoS" status on it.
(a) Is the validity of my I94 (and thus my legal stay) 1 year, or as i have read elsewhere,
if AoS is pending, then its valid till the AoS case is decided?
(b) If the validity is 1 year, what is the process for extending the I94 validity?

Since Company A has not canceled your H1, you can join them anytime.

Let us be very clear, we are MORE THAN WILLING to associate with any org that can be beneficial to us. One of the members of IV had established contact with USINPAC and it has been a very fruitful association
If anyone can do the same thing with any other org (could be 'Chinese Physicians Association', or 'Russians in America' or 'Canadians in USA' or even 'Americans for High Skilled Immigrants' - please note that I made up all the names, but please get the gist) please take the inititative and let us know how it goes.
Also note, that even if we associate with an org primarily working for a particular country, all our issues will benefit EVERYONE from every country. It is impossible to press for an amendment like 'Ability to file I485 without regard to visa number for Indian Nationals only'. The US Government doesn't allow that and neither will IV go in that direction.
The keywords here are 'publicity and exposure'. We really need that to protect our amendments in the Senate and the House Conference

He can file the H4 extension based on the H1B extension application receipt...
Even if there is a RFE..that does not stop him from filing the H4 extension..Please tell him to file the H4 extension immediately....Usually you do not send a new application along with the answers of RFE..Just file it separately....After H1 goes through they would process the H4 too may be no at the same time but that should be fine....

If we interpret each and every statement, we will come up with hundreds of comments/opinions. But no conclusion. Right now the processing for AOS is 6 months.

It will be great if any IV Guru can shed some light.
I am currently on EAD working to company B after invoking AC21 for past 1 year. Thinking of starting GC processing with current company.
So I asked my old company A to give me a copy of my approved I-140. He sent me a courtesy copy. Since i read in forums that copy of the original not courtesy is required, I sent a mail to Lawyer CC'ing my old company and I got a reply from the lawyer that he did not pay the lawyer fee. OfCourse like any desi company my old company collected lawyer fee from me. I am sure he will not pay it and already he stuck me in EB3 after promising EB2. SO I am pondering on my options.
Does any one know if I can use the courtesy copy of I-140 to proceed with my new GC process?
I read from one other forum I can use FOIA(Freedom of Information Act) and get a copy of I-140, but it will take minimum of 8 months.

This is not the appropriate place to ask this question. Most of us here are still waiting to get our green card. You may find answer to your question at another forum that have people who already took the oath.
It is ok in my opinion. This is a 'Ask a lawyer' area and people can ask any immigration related question to the panel of IV lawyers for free. We now have 15 lawyers in IV panel.

Bush said he wants to improve the working visas, I think the prority needs to offer to Canadians because Canadinas use the same language and education system, the distance is closer. We need to call all the senetors, the working visas.etc. need to go to Canadina citizens first.

Your Employer letter should be sufficient to support your wife from your employer,u don't need any other stuff,you can also tell your attorney about the form I-134 for Affadavit for support thats all you need,everything should be ok,don't worry be happy.

People who get labor approved in August, can they avail current window provided by USCIS and concurrently file 140/485?

Same thing happened with me - My labor was approved from Phily BEC on Mar 16th 07 and my company kept saying that didn't receive anything till Apr 16th 07...
Then i was impatient and called Phily BEC and they were very nice to explain me that it can take upto 1.5 months to 2 months for my company to receive via Lawyer. In fact it may take 1 month for Phily BEC to mail - he explained.
Eventually my company received the Labor papers on May 7th 07....

I have a green card and I'm thinking about living 50/50 in US and my home country Slovakia.
I've had GC for about 6 years and been living quite a travelling life spending more time outside US then in. Its also about 50/50 with trips always around 10mo in or out.My continuous residency is broken.
Do you think that if i live 50/50 in and out for five years they will give me citizenship with such history?
Got GC after Mom.
Thank you very much for effort. It will help a lot in deciding where my life will go from here.

You have 2 options. Either use your old H1 which is still valid (assuming u still have a valid visa stamp) and enter US (carry a latest offer letter from employer). If you use the old H1, then you will only have 2 more years of H1 time left.
You can file for a fresh H1 visa in Master's quota under consular processing and when its approved, attend the Visa interview, get a new H1 stamp, and re-enter using the fresh stamp. This way, you will get fresh 6 yrs time on H1.
You have 2 options. Either use your old H1 which is still valid (assuming u still have a valid visa stamp) and enter US (carry a latest offer letter from employer). If you use the old H1, then you will only have 2 more years of H1 time left.
