My H1 Extension approved from Sept'2010 - Dec 2012. LCA shows same dates and the salary shown is $5500 PM ($66000 P.A)
However recently, i noticed that i am receiving $5373(instead of $5500) per month since Sept'2010 till date.
I informed to my employer and he is willing to increase the pay from March.
Is it possible to correct it from March payroll.
Please advise.

Is it possible to have second H1b visa and Labor certificate approved for employer "B" while working on H1b visa and having Labor and I 140 approved for employer "A" ??

Yes, that is possible. However, you don't need to have a second H1B with employer "B" in order for that employer to apply for LC and 140 for you since LC and 140 are for future jobs.

I HAVE H1 APPROVED TILL 04/10 BUT I ENTERED USA USING AP THIS YEAR SO MY UNDERSTANDING IS THAT I AM ON EAD NOW WITH SPONSORING EMPLOYER. I AM ASLO DOING PARTIME JOB IN OTHER FIELD ON EAD SINCE 01/08. NOW IF I GET FULL TIME JOB WITH OTHER EMPLOYER (other field)AND IF I WORK LESS HOURS (means I get under pay than showed in labor) WITH SPONSORING EMPLOYER, WILL I BE IN TROUBLE? I have an approved i140 from old employer, using which I am planning to file i485 (As PD from old PERM/i140 is current for the month of Aug. & no labor filed for ne employer). As I am in good terms with old employer, they are ready to give me a "future employment letter" for my GC processing.
Can someone please let me know -
1. Format of the letter, details thats needs to be present in it,
2. Anything else I need from the old employer.

Depends, is the job offer/position still open? Do you intend to go back to your old company when you get the GC? If not, it is illegal to file 485 (by means of fraud) using the old i140.
If legal, I guess the job offer should just state that the offer is contingent upon getting your permanent residency.
PS: I have no experience in "future offer letter", but making a guess based on the offer letter I got when I had not yet got my H1.

One of the biggest gripe, that legal retrogressed immigrants have about the immigration system here, is that the current retrogression locks them up in one position far too long for them to grow in career. Either your company was not advised properly by your attorney or you were not aware of this simple rule that you need to work in the same job category (with as many employers as you wish subject AC21) until about six month passes after you get your green card. Otherwise you could run into trouble at some point.

I am currently on H1 Visa in the US. Am I allowed to go to school part-time and get my MBA degree ?

DEPENDS on the cost of the bond/non compete agreement /penalty.if you make more money from new jobs which will eventually cover any penalties should they try to enforce a "suspect'agreement then go for the new job :).
anyway getting a salary/pay is better than thinking about getting sued.:)

3. You must send following documents.

I left the US for good after spending around 5 years on H1-B sometime last year and have only made entries on tourist visa. Can I apply for a new 6 year H1-B quota since leaving the H1-B status last year or will I have to spend 1 year outside since the last tourist visa entry ?

My Employer applied for Labor on Aug 11th 2010 and yesterday we got the audit notice saying :
The application indicates the foreign worker is required to live on employer's premises although the application does not indicate the position is for a Live-in domestic. Please provide a detailed explanation indicating the reason the foreign worker must reside with the employer.
In ETA-9089 for Section H-17 question we have checked "Yes" but i guess it should be No.
We miss understood the question and thought it was asking about working at location and maked it yes.
my question is :
1) Can we make correction and send while replying to Audit (RFE)?
Please help on this.
