i ran my first ad..this sunday..and my lawyer didnt say a thing abt change in perm process.. but he did mention that Eb2 are being scrutinized more.

this is my understanding but a lawyer answer but you should consult a lawyer
Since you have started your GC process and shown your intent to immigrate your F1 will be denied.
H1 is a dual intent visa ( you enter as non immigrant but U can immigrate on it) and hence application of GC has no implication on it.
Again I am not a lawyer so consult one.

Thansk visakk for your reply, I am travelling thru same employer only. He still wants me to come there. Looks like he is confident & is certainly going to give me Revised Offer Letter dated in Feb 2010.
However my main question is still unanswered whether the scenario is correct to travel, considering January 8 guideline issued by DHS/USCIS. And Subsequent Deportation incidents.
I have option to travel on L2 as well. As my spouse is having L1 visa and she is going to travel in March.
But I want to be on H1B, Pleasse enlighten me on this.

I have one suggestion for the website.. Search engines are usually parameters-averse. For instance Google claims they may stop crawling if the links have too many parameters. The non-forum part of this Joomla powered website mostly utilize &s and ?s parameters in the URL.
The Joomla installation comes with an SEF component that converts &s and ?s into comma-separated directory structures.. You guys can turn it on in the admin panel. The conversion makes the URL look even uglier but it is at least SEF-compliant. Or there are other third party Joomla components that do a better job (though may require slightly more tuning)

If you want to change your location of FP appointment then you can do your FP at any location on W E D N E S D AY only(walk-in's allowed).....other weekdays for appointment people only..........tha't what USCIS customer sevice said..
but some ASC's are accepting weekday walk-in's also.................
It's not necessary to to go on the same day and same time at different location........you can go any wednesday before your appointment date.

My labour got approved but we still have to file for I-140. My h1b is going to expire on May 2007.

Yes, the new quota starts on Monday. However, you still need a current priority date and all security clearnances before you are eligible for approval. (At least that's how it will work for the most part).
Who knows if they used all the 2007 numbers up. I suspect they will be very close to having done that given the number of applications they had.
Out of the entire year quota, they can allocate only 1/4 th of it in the first quater. This is why it is impossible for USCIS to allocate the yearly quota in one day. [Whether they have such a efficient system to do so is a different debate].
I wonder why they don't have such a distribution for H1B allotment though :D

You dont have to be employed by the employer for 180 days. All you need is 485 pending for 180 days. So in the letter you can mention that 485 had been pending for more than 180 days.
The only catch is if USCIS question about your "intention" at the time of filing 485. (Since you didnt work for the company after 485, and now specifically says dont intent to..).
At the time of filing 485 you should have proper intention to join the original employer.
Maybe somebody else who went through similar experience can help u.
AC21 invocation letters typically state that you're using AC21 for switching employment after 180 days. What argument should be used to invoke AC21 in my case?

I have AOS and was recently laid off from my job. As I haven't found another job by the removal-from-payroll deadline, my H1B will expire. My question is, once I get my EAD, can I apply for a new H1B. The motivation is that I can bring a spouse over on a dependant visa only on H1B but not on AOS. How should I work this out?

I am having an option of joining a new employer with whom to file LC. Company is not very big 50 employees and started in 2002.
I am very worried about the stability of the company. This kind of companies are normal or I am just unneccessarily imagining and worrying ???

Since USCIS is done with all I-485 cases, should they not allow filing of I-485 when PD is not current? Or at least they should allow filing I-485 for the people who's I-140 is approved and PD is not current.
