I came in US with my family when I was 15-16, back then we were on L2, then as time passed by we switched to H4. Then I turned 21 so I had to go on Student Visa (F1). Still living in US legally.
Now my question is I've been staying in US over 10 years now, legally. I dont know if its rumor or not, but someone told me, that you can apply for Green Card if you lived in US over 10 years legally, is that true?
Going through all that H1B process sounds really hectic. Also all my family members, friends and relatives are here, I don't know anyone back in my birthplace. any suggestions or tips, would help a bit.

No you can not. If you were illegal you could but if you are legal you can not. H1B is the only route for you.

Hi,
My friend is facing same type of issue. He entered the US with company A with visa expiring in Jul 2006.
In Nov. 2005 he moved to company B and his I-94 was extened till Oct. 2007 (New h1 expiry date). He went to India in Dec. 2006 and entered with old visa stamp. He got new I-94 with old date i.e. Jul 2006.
Now he wants to extend his H1 and I-94 is expired. Will this create any issue? Hase anybody faced this type of issue before? All replies will be appreciated.

He is probably stucked in name check. If that clears he will get the visa.

I have the same problem...(The description of your problem is so similar to mine, I'm thinking that you might be my lawyer trying to fish for an answer to my problem...I paid her thousands of dollars and she gets her answers from the Internet...funny :D)

The I-140 was sent to Vermont, mine and my wife's I-485 have gone to "the office where they were transferred" (that really narrows it down) and my kid's I-485s were sent to Texas "it has jurisdiction over the case"
Since we live in Texas, I'm not sure why all our papers don't have Texan "jurisdiction".
My lawyers are inquiring with the USCIS and AILA (American Immigration Lawyers Association).

My parents applied for visa ..
documents submitted
1) Bank deposit in US around 9000 $
2) deposit in india about 10000$
3) Job No objection certificate ( parents )
4) affidavit's of support
5) They carried all property documents in india ( valuated by CPA )
6) my H1b1 copy and a letter of invitation from me

If she is currently on F-1 and if she wants to maintain F-1 when she comes back she will need to go to the embassy and get her F-1 visa. If she enters U.S on old unexpired H4-Visa her F-1 visa becomes invalidated and she won't qualify for OPT/CPT etc.

2.will USCIS go back that far to verify my paystubs?, and
Normall they will go back to 6 months max, but be prepare to submit the Client letter to prove that you have project for next couple of years, keep in mind that if you show client letter for only few months, USCIS is will issue only for that period, it happened for couple of guys....these days proof of project is a key for transfers...good luck....

My wife is in India currently - we both are planning on coming back in April sometime with our new born baby. My question is about getting H4 stamped for our baby.
1.Do we need to get our H1 stamped on our passport to get H4 for our kid ?

Right now, your Silverlight 2 project is set as your startup project. Set your Web Site as the startup project with the Loading_ImagesTutorial.html file as your startup page.
That should get everything working properly :)

I have returned from India on AP three days ago. Immigration officer just asked questions on my employment, but he did not ask for proof. If you have multiple APs you should submit all of them for stamping. Thats it!
I got AP..and H1B till 09..I am hoping to reenter using AP while comming back from india..Apart from AP do I require anything else. like employement letter to reenter the contry??..

AILA: Has the issue been resolved as to how to complete item 10 on Form ETA 750B? As discussed, the item asks for either 10a or 10b to be completed, whichever is appropriate, not both. Please note that Consulate location has not been a required entry since 1990. The reason the question existed was that under the pre-1990 preference system, one could process under a non-preference category with an approved labor certification and no I-140 petition so the question was necessary on the ETA 750. Since 1990, the item should have been marked "N/A". Therefore, we suggest that the item is no longer relevant.
